1. Who you are contracting with

My 'oa'oa planner is operated by Mrs Atuahiva (the "Seller"). By accessing or using the application, you agree to these Terms & Conditions. If you do not agree, please do not use the service.

2. Description of the service

My 'oa'oa planner is a web application for English as a Second Language (ESL) teachers. It helps users create, organize, and share lesson plans, sequences, resources, and media for students by grade.

3. Acceptable use

You agree not to misuse the service, including but not limited to:

  • using the service for any unlawful purpose;
  • uploading or sharing content that infringes intellectual property rights;
  • spamming, harassing, or interfering with other users;
  • attempting to access, tamper with, or reverse-engineer non-public areas of the service;
  • introducing malware, viruses, or any other harmful code.

4. Intellectual property

The Seller retains all rights to the application, its design, branding, code, and documentation. Users keep ownership of the lesson plans and content they create. By publishing content publicly, you grant the Seller a limited license to host and display that content solely to provide the service.

5. Payments, subscriptions and taxes

Certain features require a paid subscription or one-time purchase. Payment, billing, tax, subscription management, and cancellations are handled by Paddle's Buyer Terms.

Merchant of Record: Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

6. Service level

The Seller aims to keep the service available and reliable, but does not guarantee that it will be uninterrupted, error-free, or secure at all times. The service is provided on an "as is" basis.

7. Account and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date.

8. Suspension and termination

The Seller may suspend or terminate access to the service for material breach of these terms, non-payment, fraud or security risk, or repeated or serious policy violations. Upon termination, your right to use the service ceases immediately.

9. Limitation of liability

To the fullest extent permitted by law, the Seller's aggregate liability is limited to the fees paid by you in the six months preceding the claim. The Seller is not liable for indirect, consequential, or special damages such as lost profits, data loss, or goodwill, except where liability cannot be excluded by law (e.g., fraud, death, or personal injury).

10. Governing law

These Terms are governed by the laws of France, and any disputes will be subject to the jurisdiction of the competent courts of French Polynesia.

11. Changes to these terms

The Seller may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the revised Terms.
